DriBot Limited Warranty

Dribot, LLC (“Dribot”) warrants that product will be free from defects in materials and workmanship under normal use and service per the User Manual and Installation Guide for a period of eighteen (18) months from the date of shipment (“Limited Warranty”). A claim under this Limited Warranty must be presented during the Limited Warranty period and within thirty (30) days after any covered condition has occurred. A claim under this Limited Warranty shall be satisfied by either, in Dribot’s sole discretion, repairing or replacing the product and/or part(s). Replacement product and part(s) may be new or reconditioned.

The Limited Warranty period shall not be extended by the replacement or repair of product or part(s) under this Limited Warranty, but the remaining Limited Warranty period shall continue in effect and be applicable to the replaced or repaired product or part(s). Payment for cellular service covers only cellular transmission fees and in no way extends any portion of this Limited Warranty.

Product will be shipped FOB shipping point, freight collect.  Upon original receipt, take care to inspect the package contents immediately and file any delivery damage claims with the delivering carrier.  Delivery damage is excluded under this Limited Warranty. 

This Limited Warranty does not apply in the following cases: commercial, abusive, excessive, or unreasonable use, misuse, use in continuous-duty applications, accidental damage, failure to use and install according to the User Manual and Installation Guide, alteration, tampering, and repair by anyone other than or not authorized by Dribot.

The cellular service provided in conjunction with the purchase and use of product is not guaranteed or warrantied, and Dribot cannot and does not guarantee, warrant or represent that cellular service will be available in your area nor that cellular service will be continuous and uninterrupted. If cellular service is not available in your area, the sole remedy is to return product pursuant to Dribot’s Return Policy as found at www.dribot.com/return-policy . As such, Dribot is not liable for any causes of action, losses or damages of any kind whatsoever arising out of mistakes, omissions, interruptions, errors, or defects in the provision of cellular service and failures or defects in the cellular network.

Product is Wi-Fi-enabled.  Internet service is not included or provided with product.  Take proper care when connecting product to Wifi and adhere to the User Manual and Installation Guide for use and installation as Dribot is not liable for any causes of action, losses or damages of any kind whatsoever arising out of mistakes, omissions, interruptions, errors, or defects in the provision, availability or connection of internet and/or Wi-Fi to product. 

THIS LIMITED WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THOSE CONCERNING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  DRIBOT IS NOT LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY NATURE.  Since individual applications are subject to great variation, Dribot makes no representation or warranty as to suitability or fitness of products for any specific application.  Upon expiration of the Limited Warranty period, all liability of Dribot shall be terminated.

Dribot makes no representation that product will eliminate risk of property loss or personal injury or prolong the life of any equipment or other property; or that product will in all cases provide adequate warning and protection. Product, if properly installed and maintained, may only reduce the risk of property loss or other loss, but product is not an insurance or a guarantee that there will be no property loss or other loss as a result; and, CONSEQUENTLY, DRIBOT SHALL HAVE NO LIABILITY FOR ANY PROPERTY DAMAGE, PERSONAL INJURY OR OTHER LOSS. However, if Dribot is held liable, whether directly or indirectly, for any loss or damage arising under this Limited Warranty or otherwise, Dribot’s liability shall be limited to the purchase price of product, which shall be the complete and exclusive remedy against Dribot.  

This Agreement is governed by and construed according to the laws of the State of Indiana, without regard to conflict of laws.  In the event of a dispute relating to this Agreement that the parties are unable to resolve through negotiations, the parties hereby agree to the exclusive jurisdiction of the Circuit Court for Marion County, Indiana or if jurisdictionally available, the U.S. District Court for the Southern District of Indiana/Indianapolis Division.  Each party irrevocably consents to the jurisdiction of those courts and to service of process anywhere in the world.  If any provision of this Agreement is determined to be invalid under the laws of any jurisdiction where used, that provision will be deemed modified to the extent necessary to make it valid while accomplishing the purpose most similar to that contained in the original provision and will not affect any other provisions of this Agreement.
